Minnesota places DUI/DWI offenses into four degrees. These rage from Misdemeanors to Felonies. The level of charge depends on a number of factors, such as how many prior offenses a person has on their record within the past 10 years. There are also other “aggravating factors” such as: 1) blood alcohol level; 2) whether a person under the age of 16 was in the vehicle, and; 3) whether an accident was involved.
