Driving While Impaired Law

In Minnesota, it is a crime to drive, operate, or be in physical control of a motor vehicle while:

  • Under the influence of alcohol
  • Under the influence of a controlled substance
  • Under the influence of a hazardous substance that affects the nervous system or brain
  • Under the influence of a combination of any of the above
  • With a blood alcohol concentration of .08 or more within two hours of driving
  • With a blood alcohol concentration of .04 or more if operating a commercial motor vehicle
  • Operating a vehicle with any amount of a Schedule I or II controlled substance in your system

A person can be charged with DUI/DWI if their blood alcohol concentration is .08 or higher. In addition, a person can be changed without a test being conducted if their driving conduct shows that they are impaired to the extent that their ability to operate the motor vehicle is affected.

Penalties for DWI/DUI in Minnesota

The penalties for being convicted of a DWI/DUI in Minnesota range from Misdemeanors to Felonies.  Under Minnesota law, a first time offender is not required to serve any jail time. However, that calculus begins to change with multiple offense.  A second offense requires a 30 day jail sentence, a third offense requires a 90 day sentence, and a fourth or greater offense is Felony, with potential prison time involved.

What is a Motor Vehicle for Purposes of the DWI/DUI Law?

A person can be arrested for DUI/DWI for operating any of the following types of vehicles:

  • Car or truck
  • Snowmobile
  • Motorboat
  • All-terrain vehicle (ATV)
  • Motorcycle
  • Golf cart
  • Riding lawn mower
